By enrolling or participating in any of these communities, all Members agree to abide by the terms outlined herein and any specific community-based guidelines related to their care or services.
Below are the Terms regarding our Residential Payment Terms of Service, (the “Payment Terms”).
Residential Payment Terms of Service
- Introduction
Our Community facilitates payments for services provided by residential facility operators on our platform. We are dedicated to ensuring transparency and trust by not charging referral fees or commissions, which traditionally create financial burdens for operators. The Payment Terms outlined here explain the processes governing all transactions on the platform.
- Elimination of Referral Commissions
As emphasized in our Terms of Service (Section 10), our Community operates on a no-fee model, meaning we do not charge families, patients, residents, or operators any referral commissions or placement fees. Historically, these fees have been as high as 120%-200% of the first month’s rent, causing budget deficits for operators and negatively affecting residents’ quality of life and care. Our Community’s goal is to fix this broken system by removing these commissions entirely.
- Payment Methods
3.1 Accepted Forms of Payment
We accept the following forms of payment for any services facilitated through MemoryWatch:
- Credit/Debit Cards (Visa, Mastercard, American Express)
- PayPal
- ACH Transfers (where applicable)
3.2 Third-Party Payment Processors
Payments made through the Community platform are processed by third-party payment providers (e.g., Stripe, PayPal). By making a payment, you agree to these third-party providers’ terms as they facilitate the transactions.
- Payment Processing Fees
4.1 Processing Fees
While our Community does not directly charge fees to families, residents, or operators for core services, payment processing fees (e.g., credit card or ACH transfer fees) are passed on to the Operators. These fees are determined by the third-party payment processors and are transparently communicated to Operators in a separate Payment Schedule.
4.2 Transparent Fee Disclosure
All payment processing fees will be clearly displayed to Operators during the payment process, and the Community will ensure multiple payment options to best suit each operator’s preferences and minimize costs.
- Relocation Assistance and Payment Facilitation (Satisfaction Guarantee)
5.1 Relocation Services
The Community offers relocation assistance at no additional cost to residents, provided all payments are processed through our platform. This includes the proration of service fees and the coordination of deposits and payments to ensure families can relocate without financial disruption.
5.2 No Duplicate Payments or Lost Deposits
As part of our Satisfaction Guarantee, we ensure that residents who relocate will not be charged duplicate payments or forfeit any deposits. The Community coordinates directly with Operators to manage the proration of payments and ensure that financial transitions during relocations are seamless.
- Cancellations and Refunds
6.1 Operator Cancellation Policy
Operators set their own cancellation and refund policies, and these will be detailed in your contract with them. The Community facilitates payment processing but is not responsible for cancellations or changes to bookings.
6.2 Relocation and Refund Requests
If a resident relocates, the Community will facilitate any refunds or prorations according to the Operator’s policy. Any relocation fees incurred will be charged directly to the Operator or resident as applicable, but the Community ensures the payment process is smooth and transparent.
- Payment Disputes
7.1 Dispute Resolution
In the event of a payment dispute, the Community will act as a facilitator between the parties involved (e.g., the resident and the Operator). Payment disputes must be reported to the Community within 30 days of the transaction.
