SMS Terms of Service

This is a policy of Silver House Healthcare LLC (“we,” “us,” “our,” or “Silver House”) and applies to its Collaborative Care Communities, which include but are not limited to MemoryWatch™, Circles™, and BATWatch™. These communities are collectively or individually referred to as (our “Community,” “MemoryWatch,” “Circles,” or “BATWatch”).

Each Collaborative Care Community has been specifically developed to target distinct stages and aspects of cognitive health management:

  • MemoryWatch™ is a program that focuses on supporting individuals and families impacted by cognitive decline or dementia, providing access to a vast network of healthcare providers, assisted living facilities (ALFs), and support systems tailored to these needs.
  • Circles™ is a program that serves those in the pre-clinical stages of cognitive decline, offering social, lifestyle, and wellness activities aimed at promoting cognitive health early in life to prevent chronic stress and long-term decline.
  • BATWatch™ is a program designed to empower healthcare providers by offering resources and collaborative frameworks to support early detection and management of Alzheimer’s through BAT Levels™ monitoring, testing, and treatment.

By enrolling or participating in any of these communities, all Members agree to abide by the terms outlined herein and any specific community-based guidelines related to their care or services.

SMS Terms

Scope: This SMS Policy governs the use of automated text messaging services across the Community, including messages sent by Silver House and other Community Members. By opting in to receive SMS communications, you consent to the terms outlined below.

Purpose of SMS Communications:

The Community is committed to providing cost-effective communication solutions to ensure efficient healthcare coordination. Our SMS services are utilized by Community Members, including healthcare providers, caregivers, and partner organizations, to streamline communication regarding cognitive health services, resident placement inquiries, and appointment reminders.

Our SMS services do not include any marketing messages. Instead, they are used for important reminders and updates such as:

Appointment reminders (e.g., “You have an appointment at [Facility Name] on [Date] at [Time].”).

Resident placement inquiries (e.g., notifying operators of non-sensitive, de-identified information about potential interest in facility placement).

Billing reminders (e.g., “A payment is due on your account” or “You have a billing issue. Please check your account.”).

No sensitive information, including Protected Health Information (PHI), will be included in SMS messages. Only de-identified information will be used for notifications.

Opt-In and Consent:

By providing your phone number and opting into SMS communications, you agree to receive messages from Silver House or any of its Community Members. These messages may include:

Appointment confirmations.

Reminders about upcoming bills or outstanding account balances.

Notifications regarding resident placement inquiries for network operators (de-identified).

By opting in:

Authorization: You expressly authorize Silver House and its Community members to send automated or manual text messages to the mobile phone number you provided.

Non-marketing: You acknowledge that these communications will not contain marketing content.

Consent for electronic records: You consent to the use of an electronic record to document your opt-in. To withdraw this consent, reply STOP to any SMS, visit your account settings, or contact Silver House via the methods in the “Contact Us” section below.

Confirmation: You confirm that you are the subscriber or customary user of the mobile phone number you provided.

Message and data rates may apply.

Types of SMS Messages:

Appointment Reminders:
Silver House and Community Members will send reminders related to your healthcare appointments, ensuring you stay on track with your cognitive health journey. The reminders will not contain any PHI and will include only de-identified appointment details.

Resident Placement Notifications (for Operators):
As part of Community’s goal to streamline patient placement, operators will receive SMS notifications alerting them to inquiries or interest in facility placement. Only de-identified information will be shared.

Billing Reminders:
You may receive SMS notifications related to your account, including reminders of upcoming payments or billing issues. These reminders are designed to prevent service disruptions and help you maintain compliance with payment plans.

Your Rights:

Opt-out: You can withdraw your consent to receive SMS messages at any time by replying STOP to any message or managing your preferences in your account settings. Opting out may limit certain features, such as appointment reminders.

Help: For assistance, you can text HELP in response to any message or contact our customer service team.

Security: Silver House and its Community Members make commercially reasonable efforts to ensure that SMS messages are delivered promptly. However, Community is not responsible for delayed or undelivered messages.

Confidentiality and Security:

Silver House and its Community Members prioritize your privacy and data security. We ensure compliance with HIPAA and other applicable data protection laws. SMS messages sent through our system contain no sensitive or identifiable PHI, and all communications are subject to the Community Privacy Policy. De-identified information is used in all SMS reminders, ensuring your information is safeguarded.

Limitations of Liability:

Silver House and its Community Members are not responsible for any delays, technical issues, or failures in the delivery of SMS messages. By opting in, you acknowledge that:

Message Delivery: SMS message delivery is dependent on your mobile carrier and may be affected by factors outside of Silver House and its Community Members’ control.

Liability Waiver: Silver House and its Community Members are not liable for any damages arising from the use of SMS services, including, but not limited to, issues caused by delayed or undelivered messages.

Amendments and Updates to this Policy:

Silver House and its Community Members reserve the right to modify this SMS Policy at any time. We will notify you of any material changes by updating this page and sending an alert to the contact information you have provided.
